Delhi High Court has restrained Magic Media World (MMW) from printing and circulating its beauty magazine â€˜Revonâ€™ as it infringed the trademark of the US-based cosmetic manufacturing company, Revlon.
Justice S Ravindra Bhat yesterday asked the publishers Magic Media World to stop publishing their magazine as the name Revon resembled Revlon, the well-known brand of cosmetic products, and gave the impression that both were floated by the same company.
The petitioner, Revlon Manufacturing Ltd, through its lawyers Chander Lal and Mr Aashis, approached the court seeking a stay against the use of the trade mark Revon in any manner by the defendants.
Mr Lal contended that Revlon, which produces all sorts of beauty products, registered under the laws of Bermuda and is a subsidiary of the US-based company, Revlon Consumer Products Corporation, had registered its trademark all over the world, including India.
He alleged that Magic Media World, printer and publisher of the magazine, had â€˜infringed its trademark and used it to launch a magazine which appears similar to Revlon.â€™ Mr Lal contended that MMG, on their website, had shown that they were manufacturing cosmetic products under the name of Natureâ€™s Essence. They had launched the beauty magazine under the title Revon, which was virtually identical to their well-known brand Revlon. The tagline, used along with the title â€˜The Beautiful Revolutionâ€™, was further directly indicative that they were capable of causing deception and confusion in the minds of general public that the magazine was in some manner related to Revlon, the lawyer contended.
They further alleged that the defendants had chosen the brand name Revon to take unfair advantage of the reputation and goodwill of the petitionerâ€™s well-known trade mark Revlon.
