The Supreme Court has upheld the Karnataka government’s acquisition of land in Kannamangal village for the construction of an access road to the Bangalore Airport. “Though the rights of an individual whose property is sought to be acquired must be scrupulously respected, an acquisition for the benefit of the public at large is not to be lightly quashed and extraordinary reasons must exist for doing so,” a bench of Justice Tarun Chatterjee and Justice H S Bedi observed. Time has come where the courts should keep the larger public interest in mind while exercising their power of granting stay/injunction, the bench said citing an earlier observation made in the Ramniklal N Bhutia Vs State of Maharashtra case.
