SC to hear Yakub Memon’s plea against execution on Monday

The Supreme Court of India has agreed to hear on Monday the two petitions against the execution of Yakub Memon in the Mumbai serial blast case. One of the petitions is filed by Yabub Memon and the other one is by the Centre on Death Penalty at National Law University, Delhi. It was yesterday that Yakub Memon had moved the Supreme Court seeking stay on the execution of his death sentence on 30th July on the grounds that all the legal remedies have not yet been exhausted. Prior to this, he had also filed a fresh mercy petition with Maharashtra Government immediately after the Supreme Court had rejected his curative petition. His petition says that the death warrant against him was issued even before he could exhaust his last legal remedy, the curative petition which was dismissed two days back by the apex court.  Yakub Memon cannot be executed on 30th July even if his mercy petition is rejected as Supreme Court in a landmark judgment had observed that “It is necessary that a minimum period of 14 days be stipulated between the receipt of communication of the rejection of the mercy petition and the scheduled date of execution.”
