MINORITY SCHOOLS ALSO UNDER DELHI GOVERNMENT RULES, SAYS DELHI HIGH COURT

The Delhi High Court has said that minority schools are also covered under the Delhi Government rules for admissions of students in the Nursery class.

A bench comprising Chief Justice M K Sharma and Justice Sanjive Khanna dismissed the petition of Minority Schools who had challanged the Single Bench order which had ruled that Ganguly Committee rules should be followed by all schools including Minority Schools while admitting the children in nursery class.

The Bench observed that since the Delhi Government had framed rules for Nursery admissions which were based on the Ganguly Committee Recomendations and were applicable uniformly to all schools in the Capital including the Minority schools, no separate rules could be followed by the Minority schools.

Ashok Aggarwal of Social Jurist (NGO) had approached the court saying that the Minority Schools, in the garb of admitting children of the minority class, were indulging in malpractices in the admission process.

The Minority Schools had contended that as per Article 30(1) of the Constitution, they have absolute immunity and Ganguly Committee Recommendations and Delhi Government Rules regarding admissions of children in the Nursery class were not applicable to their schools.

The bench, however, dismissed their petition stating that all schools in the Capital came under the umbrella of Delhi Government Rules framed recently for admission of children in the Nursery class.
