SC REFUSES TO ISSUE DIRECTIONS TO CONTROL MISLEADING ADS ON MAKERS OF SOFT DRINKS
The Supreme Court has refused to issue directions to control alleged misleading advertisements on makers of soft drinks after the centre said that adequate provisions are already in place to deal with the issue. A bench comprising Justice A K Mathur and Justice Dalveer Bhandari said, "Rule 43 (A) of the Prevention of Food Adulteration Act, 1955 is in existence to deal with the misleading advertisements." "If that is being flouted, the remedy lies in approaching the appropriate authority," the court said. The court said the concerned magistrate can pass direction on the basis of individual complaint. This court can not pass a general direction on the alleged misleading advertisements, said Justice Mathur.
