GOOGLE BEATS INDIAN COS IN DOMAIN CASE
GOOGLE, the world’s largest Internet company, has clinched victories on disputes on domain names at the World Intellectual Property Right Organisation (WIPO) against two Indian entities.
The WIPO arbitration and mediation centre has transferred domain names googlehrd.com and mygooglemoney.com, used by Kolkata based Ascio Technologies Inc and Net Jobs of Rajasthan, to Google.
Google, which has 60% of the market share in worldwide searches, had complained to the WIPO that Sudam Chakraborty and Thilak Raj, owners of the two Indian firms, took its trade name for commercial purposes.
WIPO held that both the domain names were registered in “bad faith” and the Indians running their commercial interests through them had no right over the trade name “Google”, which was used to confuse Internet users. The complaints were decided under uniform domain name dispute resolution policy (UDRP) last month after Chakraborty and Raj failed to fulfil the requirements of the notice sent to them by the tribunal.
