LODHA ASKED TO MAINTAIN STATUS QUO
The Birlas had filed applications for the appointment of administrators
over all the assets and properties of the MP Birla Group.
They had also prayed that Mr Lodha be restrained from exercising
any control over the group companies.
Responding to a clarification sought by a Lodha counsel, justice
Kalyan Jyoti Sengupta explained after delivering the judgement
that no order of injunction has been passed restraining Mr
Lodha from exercising any control over the MP Birla Group
companies.
In
the course of hearing the applications, senior Lodha advocates
Shakti Nath Mukherjee and Anindya Mitra, who appeared with
Pratap Chatterjee, Dhruvo Ghosh, Amitesh Banerjee and Sanjiv
Trivedi, offered an undertaking that all assets and properties
mentioned in the affidavit of assets would be preserved and
protected.
The undertaking was recorded in the judgement, which also
directed Mr Lodha to preserve and protect the property and
assets as contained in the affidavit of assets, including
any share or other property that might come in his hands.
The court also said that in case any board resolution regarding
disposal of assets or removal of directors in any of the MP
Birla Group companies was to be considered, prior notice needs
to be given to the defendants
